Employment Litigation When an employee is terminated from a position or must leave a job due to sexual harassment, bias or other workplace issues, both plaintiff and defendant need to determine the past and future economic consequences of this event. The employability expert can evaluate and document factors including loss or damages incurred in earnings and benefits and the impact on future employability and earnings. Wexler Consulting researches the current and past labor markets and evaluates the plaintiff's job search efforts in obtaining comparable employment in this job market. What to look for in an effective evaluator? The Court looks for an expert witness who has the appropriate training and expertise in vocational and career assessment. The Evaluator may have additional experience in job placement, recruitment or hiring. The Evaluator should employ scientific methodology to assess, research, evaluate, and document an individual's highest-level employment capacity and combine this with labor market research. The Evaluator/Employability expert will conduct a full interview of the person to be evaluated to include their employment and job history, education, training and skills. In addition, the evaluator may conduct testing and surveys to determine the individual's strengths, weaknesses, and interests. The evaluator researches the targeted job market. For the unemployed or under-employed individual the evaluation may include job search strategy and activity. The evaluation may include recommendations for additional resources and action in the individual’s job search. The evaluator then prepares a detailed, objective, accurate evaluation of that person's value in the job market which is submitted to the referring attorney.
