To evaluate alimony decisions (rehabilitative, permanent or term) a vocational assessment is indicated when:
The court may also order such an assessment. If requested by a party, it is likely that a Court will require the party seeking spousal maintenance to cooperate with such an assessment. What to look for in an effective evaluator? The Court looks for an expert witness who has the appropriate training and expertise in vocational and career assessment. The Evaluator may have additional experience in job placement, recruitment or hiring. The Evaluator should employ scientific methodology to assess, research, evaluate, and document an individual's highest-level employment capacity and combine this with labor market research. The Evaluation Process: The Evaluator/Employability expert will conduct a full interview of the person to be evaluated to include their employment and job history, education, training and skills. In addition, the evaluator may conduct testing and surveys to determine the individual's strengths, weaknesses, and interests. The evaluator researches the targeted job market. For the unemployed or under-employed individual the evaluation may include job search strategy and activity. The evaluation may include suggestions for additional resources and action for the individual's search for employment. The evaluator then prepares a detailed, objective, accurate evaluation of that person's value in the job market which is submitted to the referring attorney.
